1. Introduction
These Terms of Service (“Terms”) govern your access to and use of WPoptic, including but not limited to:

The WPoptic browser extension

The WPoptic website and platform available at wpoptic.com

Website technology, plugin, and infrastructure datasets

Any related APIs, dashboards, exports, and paid data services
(collectively referred to as the “Services”).
WPoptic provides technology detection and website data with a focus on WordPress-based websites.
By accessing or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use WPoptic.
2. Intellectual Property
All content, datasets, software, algorithms, detection methods, trademarks, branding, and underlying technology used in WPoptic are the exclusive intellectual property of WPoptic or its licensors.
This includes but is not limited to:

Website technology and plugin detection data

Aggregated and historical datasets

Scoring, classification, and enrichment logic

The WPoptic database and collection methodology
You may not copy, reproduce, modify, distribute, sell, license, or otherwise exploit any part of the Services or data unless explicitly permitted in writing by WPoptic.
3. Use of the Services
You are granted a limited, non-exclusive, non-transferable, revocable license to use WPoptic for internal analysis, research, or business intelligence purposes.
You may only analyze websites that you own, operate, or have legitimate permission to analyze, or that are publicly accessible for general technology detection.
You must not:

Republish, resell, sublicense, or redistribute WPoptic data or datasets

Use WPoptic data to create or enhance a competing product or service

Build lead lists or contact databases for unsolicited spam

Scrape, bulk-download, or automate access outside of permitted limits

Circumvent technical restrictions, rate limits, or access controls
Any usage outside the scope of this license requires a separate written agreement.
4. Accounts & Access
Certain features of WPoptic, including premium data, exports, dashboards, or API access, require account registration.
You agree to:

Provide accurate and up-to-date account information

Keep your login credentials secure

Accept responsibility for all activity under your account
WPoptic reserves the right to suspend or terminate accounts that violate these Terms or abuse the Services.
5. Paid Services, Data Sales & Subscriptions
WPoptic offers free and paid plans, including subscriptions and one-time data purchases.
By purchasing or subscribing, you agree that:

Fees are charged monthly or annually depending on your plan

Cancellations are self-service via your account dashboard
-
No refunds are provided for change of mind or unused time
Refunds may only be issued if a service is materially faulty or not delivered as promised, in accordance with Dutch and EU consumer law.
API Access & Data Licensing
API access and downloadable datasets are licensed, not sold.
You may not:

Share API keys or access with third parties
-
Resell or redistribute API or exported data

Store or cache data beyond permitted timeframes
WPoptic enforces usage limits to ensure fair access. Abuse may result in throttling, suspension, or termination without refund.
6. Fair Use & Data Protection
All usage is subject to fair use principles.
Excessive queries, high-frequency scanning, systematic data harvesting, or abnormal usage patterns intended to extract bulk datasets may result in:

Temporary rate limiting

Account suspension
-
Permanent termination of access
WPoptic reserves sole discretion in determining what constitutes abusive or excessive usage.
7. Acceptable Use
You agree not to use WPoptic:

For unlawful, fraudulent, or deceptive purposes

To violate privacy, data protection, or anti-spam regulations
-
To reverse-engineer or tamper with WPoptic systems

In any way that harms WPoptic’s infrastructure, data integrity, or reputation
You are solely responsible for ensuring your use complies with applicable laws.
8. Data Accuracy & Limitations
WPoptic aims to provide high-quality and up-to-date technology detection data. However, detection is based on automated methods and public signals.
We do not guarantee:

100% accuracy or completeness

Real-time correctness
-
Detection of intentionally hidden or obfuscated technologies
Data may be outdated, misidentified, or incomplete. You acknowledge that all data is provided for informational purposes only.
9. Changes to the Services or Terms
WPoptic may update these Terms or modify the Services at any time.
Updated Terms will be published on wpoptic.com with a revised “Last Updated” date. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
10. Termination
You may terminate your account at any time via your dashboard.
WPoptic may suspend or terminate access immediately if you breach these Terms, misuse the Services, or pose legal or operational risk.
Termination does not relieve you of payment obligations or data usage restrictions.
11. Limitation of Liability
The Services are provided “as-is” and “as-available,” without warranties of any kind.
To the fullest extent permitted by law, WPoptic shall not be liable for:

Indirect, incidental, or consequential damages

Loss of revenue, profits, data, or business opportunities

Decisions made based on WPoptic data or analysis
Total liability shall not exceed the amount paid by you to WPoptic in the twelve months preceding the claim.
12. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be exclusively submitted to the competent courts of the Netherlands.
